Clearinghouse II is a set of regulations that require states to remove Commercial Learner's Permit (CLP) or Commercial Driver's License (CDL) privileges within 60 days after a violation. But here’s where it gets interesting: each state has its own rules and timelines for sending out those letters and implementing these changes.

State-by-State Differences

In 2016, every state legislature was mandated to decide how to handle drivers’ violations. Some states act quickly and pull the driver’s CDL immediately. Others have set time frames like 30 or 45 days. For example, in North Carolina, employers must report violations to the DMV within 5 days, and the CDL is promptly pulled.

Employer Responsibilities

Employers, it’s essential to understand your responsibilities under these regulations. You need to stay compliant with the DOT rules, specifically outlined in 49 CFR Part 40 Section 40.307. This includes working closely with Substance Abuse Professionals (SAPs) to ensure confidentiality and proper reporting.
