1. Fatal Accidents

  1. Mandatory Testing – If an accident results in a fatality, the driver must undergo a post-accident drug and alcohol test, regardless of fault.

2. Bodily Injury with Immediate Medical Treatment

  1. Testing Required – If anyone involved in the accident requires immediate medical treatment away from the scene, and the driver receives a citation within 32 hours, a post-accident drug test is mandatory.

3. Disabling Damage to Vehicles

  1. Testing Required – If one or more vehicles sustain disabling damage and must be towed away, and the driver receives a citation within 32 hours, a drug test is required.

Timing of the Test

The timing of post-accident drug and alcohol tests is critical:

  1. Alcohol Test – Should be conducted within 2 hours of the accident, but no later than 8 hours.
  2. Drug Test – Should be conducted within 32 hours of the accident.

If testing is not completed within these timeframes, the employer must document the reason for the delay.
