The Department of Transportation (DOT) mandates that all Return-to-Duty (RTD) drug tests be conducted under direct observation to ensure the integrity of the testing process. This procedure is designed to prevent tampering, substitution, or adulteration of the sample, which is critical for maintaining safety in DOT-regulated industries. Below, we’ll outline the proper procedure for observed RTD drug tests according to DOT regulations.
When is Direct Observation Required?
Direct observation is mandatory for:
- Return-to-Duty Tests – After completing the SAP process, all RTD drug tests must be observed.
- Follow-Up Tests – Any follow-up drug tests required as part of the SAP’s recommendations are also conducted under direct observation.
- Tampering or Suspicious Behavior – If an employee previously tampered with a test or exhibited suspicious behavior, direct observation is required.
Step-by-Step Procedure for Observed RTD Drug Tests
- Same-Gender Observer
- The observer must be the same gender as the employee being tested. This ensures privacy while adhering to DOT regulations.
- Initial Check for Devices
- Before the test begins, the observer will ask the employee to:If a device is found, the observer will immediately notify the collector, and the test will be stopped. This is considered a refusal to test.
- Raise their shirt, blouse, or dress/skirt above the waist (just above the navel).
- Lower their clothing and underpants to mid-thigh.
- Turn around to show that no prosthetic or other devices are being used to tamper with the test.
- Observed Sample Collection
- The observer must watch the urine go directly from the employee’s body into the collection container.
- The employee is then allowed to return their clothing to its proper position.
- Handling the Sample
- The employee must carry the sample to the collector while the observer ensures the sample remains in view.
- The collector completes the chain of custody process and prepares the sample for laboratory testing.
- Refusal to Comply
- If the employee refuses any part of the direct observation procedure, it is considered a refusal to test, which carries the same consequences as a positive test result.
Why Direct Observation is Important
Direct observation ensures the integrity of the testing process by:
- Preventing tampering or cheating.
- Maintaining confidence in the RTD process.
- Upholding safety standards in DOT-regulated industries.
